In case of delay, the compensation is calculated without considering connecting flights

  • 11/09/2017

Article 7 of Regulation (EC) no. 261/2004 establishes common rules on compensation and assistance in the event of denied boarding and of cancellation or long delay of flights.

Therefore, in the event of delays of more than three hours, passengers receive compensation amounting to Euro 250 for all flights of 1.500 kilometres or less; Euro 400 for all intra-EU flights of more than 1.500 kilometres and for all other flights between 1.500 and 3.500 kilometres; and Euro 600 for all other flights.

With Judgment of 7th September 2017 in Case C-559/16, the European Court of Justice has stated that the amount to be given to passengers who are victims of a delay, is to be calculated by taking into account the distance between the first point of departure and the final destination. The Court has highlighted that the provision at issue provides for a right to compensation without distinction as to whether the passengers reach their final destination by means of a direct flight or an air journey with connecting flights.
