The statement of account balance, if definitive, has evidentiary effect, until proof to the contrary, also against the guarantor of the account holder

The Court of Cassation, in its judgement of 20 March 2024, no. 7329, rendered in banking matters, ruled that "in bank account agreements, the statement of account balance has evidentiary effectiveness, until proof to the contrary, even against the guarantor of the account holder. This evidentiary effectiveness extends not only to the granting of the injunction, but also in the proceedings for opposition to the same and in any other proceedings of cognition".
