Non-pecuniary damage resulting from the heartache generated by the delay in crediting a large sum is refundable

The Court of Cassation with the decision n. 24643 of September 13th, 2021, confirmed that non-pecuniary damage from stress or heartache deriving from a breach of contract also falls within the non-pecuniary damage. In particular, the Supreme Court recognized the compensation of moral damage to the account holder who had had to take psychotropic drugs and had spent sleepless nights due to the delay in crediting a substantial sum of money.
