Death and compensation for damages: latest news.
- 19/05/2020
The Court of Cassation, with sentence no. 8532 of May 6, 2020 provided that in the event of the death of the damaged party, the damage paid according to the Milan tables must be reduced proportionately by the court of merit, having regard to the time of actual survival of the injured party. In particular, the trial judge will have to adopt the proportion criterion, according to which the compensation that would have been paid to a living person is the number of years that he still had to live according to the mortality statistics, such as the compensation to be paid to the person already deceased is the number of years actually lived between injury and death.
