Approved by the European Parliament the Copyright Directive: the main critical points

  • 25/09/2018

On 12 September 18, the European Parliament approved the “Directive of the European Parliament and of the Council on Sopyright in the Digital Single Market”. The parliamentary debate focused mainly on two articles: the art. 11 (Protection of press publications concerning digital uses) and the art. 13 (Use of protected content by information society service providers storing and giving access to large amounts of works and other subject-matter uploaded by their users).

The first article provides that publishers could obtain, by service providers, a fair and proportionate remuneration for the digital use of their journalistic publications. The second one provides that online platforms are required to monitor what is uploaded by users, in order to enforce the copyright protection.

From the introduction of these greater guarantees, however, could ensue a too high burden for the operators of online platforms, that could become an obstacle to the circulation of information.
