An uncontested invoice can prove the existence of a contract

The Court of Cassation, by Judgment no. 11736 of 15th May 2018, has stated that a commercial invoice, which is unilaterally issued and whose function is to prove the existence of elements regarding the execution of a contract, is a declaration addressed to the other party about facts related to an already existing contractual relationship.
Therefore, where - such as in the case at issue - this relationship is not contested by any of the parties, a commercial invoice can validly prove by itself the fulfillment of a contract, especially if the debtor had previously accepted without any claim the invoices issued during the execution of the said relationship.
