Turnover as a criterion for assessing the technical and professional capabilities of a company participating in a public tender

The Council of State, section V, in its judgment of 4 November 2024, no. 8711, rendered on the subject of tenders, established that ‘technical and professional capacities presuppose not only the possession of human and technical resources to be immediately employed in the performance of the service, but also the possession of experience, both elements necessary “to perform the contract with an adequate standard of quality”; in this direction: the “specific turnover referring to similar services” is aimed precisely at revealing the level of experience already acquired by the auxiliary company’.
