The TAR Lazio, with Ruling no. 9451 of 11.7.2022, has defined the requirements in order for the Anticorruption Authority (ANAC) to record data and information concerning public procedures, according to article 213, paragraph 10, of legislative decree no. 50/2016.
In particular, the TAR has stated that ANAC has to justify the usefulness of the annotation, which requires a conduct contrary to a provision of law or suitable to raise doubts about the reliability of the economic operator at issue.
