Divorce, the wife does not keep her husband's surname just because he is a famous doctor

With Sentence n. 654 of 11th January 2022 the Court of Cassation ruled on the possibility of the wife to keep her husband's surname even after the divorce. In particular, the Court reiterated that pursuant to art. 5 co. 3 of Law 898/1970 (divorce law), the possibility of continuing to use the husband's surname after the divorce must depend on an interest worthy of protection and which, in any case, cannot coincide with the mere desire to retain as an identity trait the reference to a family relationship that has now ended.
