Digital signature: “CADES” and “PADES” formats are equivalent for notification purposes

The United Sections of the Court of Cassation, with sentence no. 10266 of April 27, 2018 have established that the digital signatures formats “PADES” and “CADES” are equivalent, as both offer guarantees of authenticity and security, although there is a difference in the extension (.p7m on the one hand and .pdf on the other) of the respective generated files.
In justifying its decision, the Court recalls the European Union Law, according to which the digital signatures “CADES” or “PADES” must be recognized and validated by all the member countries, without any exception. In fact, in order to guarantee a uniform discipline of digital signature in the EU, European standards have been adopted through the eIDAS Regulation, which requires Member States to recognize digital signatures affixed, according to certain standards which include both “CADES” and “PADES”.
