The deed of sale which excludes the transfer of ownership of the common parts of a condominium is void.

The Supreme Court with ruling of 26 January 2021, n. 1610 argued that the clause contained in the contract for the sale of a real estate unit of a condominium, with which the ownership of some of the common parts is excluded from the transfer is void since, through the same, it is intended to implement the renunciation of a condominium to the aforementioned parties which is, however, prohibited by the paragraph of art. 1118 of the Italian Civil Code.
