The class action is in the “Gazzetta Ufficiale” but its enforcement is postponed by one year

The Official Journal no. 92 of 18 April 2019, contains the Law no. 31 of 12 April 2019 about "Provisions regarding class actions".

The Collective Action, a procedure which until now was only part of the Consumer Code, will be placed in a new Title VIII bis of the Code of Civil Procedure, entitled "of collective proceedings". Class Action loses its consumerist connotation and will be used by any subject who claim for compensation to a damage to "individual and homogeneous rights".

Article. 7, however, shifts the enforcement of the Law in twelve months, "in order to allow the Ministry of Justice to prepare the necessary changes to the information systems to enable the eletronical procedural activities to be completed". The provisions of the law, therefore, will be applied only to the unlawful conduct that take place after the date of its entry into force.
