With its own sentence no. 8514 of 16th December 2019 the Fifth Section of the Council of State established that the participants in the tender procedures of the public administration are obliged to communicate to the latter all events, including those that arise, concerning the conduct of its business professional. This is to allow the contracting authority to assess the possible impact of these precedents on the concrete and effective reliability, both professional and moral, of the competitors.
