Public procurement: no preliminary assistance if the technical and / or economic offer is lacking.

The Council of State, with decision no. 2003 of 21 March 2022, on the subject of preliminary investigation in public procurement, stated that the lack of the economic and technical offer cannot in any way be remedied through the preliminary investigation procedure, because this possibility in relation to any shortage and / or unintelligibility of the technical and / or economic offer is strictly supervised and limited by the reference legislation.
