European Court of Justice says no to the provision of mandatory tariffs for architects and engineers provided by German law

The European Court of Justice, with Judgement of July, 4th 2019, Case C-377/2019, European Commission v. Federal Republic of Germany, stated that the binding minimum and maximum rates for planning services, foreseen in the German law, is not compliant with the Article 15 of the EU Services Directive (Directive no. 2006/123/EC). According to the Court’s decision, in fact, the German regulation was judged to be inconsistent in relation to the objective of preserving a high level of quality of planning services.
