Coronavirus: offenses configurable in case of violation of the provisions of the D.p.c.m. of March 8, 2020

For those who violate the rules on movements provided by the Decree of the President of the Council of Ministers of March 8, 2020, then extended to the whole national territory with the Decree of the President of the Council of Ministers of March 9, 2020 is applicable art. 650 of the criminal code (non-compliance with the Authority's regulations), which provides the penalty of arrest up to three months or a fine up to 206 euros, unless it could be configured the most serious hypothesis provided by the art. 452 of the criminal code (culpable crimes against public health) which provides the penalty of imprisonment up to 12 years. The criminal consequences deriving from false declarations made on the self-declaration form to a public official are provided by art. 76 of Presidential Decree no. 445/2000, which recalls the crimes of forgery, also committed against public officials and by art. 495 of the criminal code (false attestation or declaration to a public official on the identity or personal quality of oneself or others) which provides the penalty of imprisonment from one to six years.
