- 06/02/2017
On 1st February, after the positive examination by the Tenth Permanent Commission, the Chamber of Deputies has approved a bill on “Delegation to the government for the reform of insolvency law”.
This bill sets the general principles for the organic reform of insolvency proceedings and over-indebtedness settlement procedures, now regulated by Royal Decree of 16th March 1942, no. 267 (Insolvency Law).
In particular, a new liquidation procedure will take the place of current bankruptcy proceedings. Also, a preliminary alert stage will be introduced and access to reorganization plans and debt restructuring agreements will be easier.
For the final text of the reform, it is now necessary to wait for the approval by the Senate, which is due in the following months.
