The Constitutional Court rules on the decriminalization of the crime of injury

The Constitutional Court, with sentence no. 37 of 6 March 2019, stated on constitutional legitimacy issues, raised by the Territorial Court of Venice, based on the decriminalization of the offense of injury, introduced by Legislative Decree January 15, 2016, n. 7.
In the opinion of the Court, from the recognition of a fundamental right, such as the right of honor, the obligation for the order to ensure its protection through criminal sanctions does not necessarily follow, since it is also possible to carry out civil law remedies. Issues are therefore unfounded.
